1. Scope & Who We Are
This Privacy Policy describes how Oscar's Phones LLC ("Oscar's Phones," "we," "us," or "our") collects, uses, shares, and protects your personal information when you visit oscarsphones.com (the "Site"), request a quote, sell us a device, or otherwise interact with our business.
Oscar's Phones LLC is a Texas limited liability company with a registered mailing address at 10223 Broadway St, Ste P604, Pearland, TX 77584. We buy used phones, tablets, laptops, watches, and related consumer electronics and pay sellers in cash, Zelle, or CashApp.
By using the Site or our services, you agree to this Policy. If you do not agree, please do not use the Site or submit information to us.
2. Information We Collect
A. Information you give us
- Identity & contact: first and last name, phone number, email, and (when relevant) pickup address.
- Device information: model, storage, condition, carrier, IMEI, iCloud/MDM status, and any photos you send.
- Transaction details: agreed price, payment method (cash, Zelle, CashApp), and meetup or dropoff location.
- Communications: messages you send via SMS, email, contact form, or chat widget, including any attachments.
- Identity verification: when required by law or fraud prevention, we may record seller name and a government-issued ID number at the point of sale. We do not retain digital copies of ID documents.
B. Information collected automatically
- IP address, general location (city/region level), browser type, operating system, device identifiers.
- Pages viewed, referring URL, time on page, clickstream, search terms used on the Site.
- Cookie IDs and similar tracking technologies. See Section 5.
C. Information from third parties
- Advertising and analytics partners (e.g., Google, Meta) who report on ad performance.
- Payment service providers who confirm a transfer has cleared.
- Public databases we use to confirm that a device is not reported lost or stolen.
D. Sensitive personal information
We do not knowingly collect sensitive personal information such as Social Security numbers, financial account credentials, precise geolocation, biometrics, racial or ethnic origin, religious beliefs, sexual orientation, or health information. Please do not send us this type of data.
3. How We Use Your Information
We use the information we collect to:
- Respond to quote requests and provide the buyback service you asked for;
- Schedule pickups, dropoffs, and payments, and send confirmations;
- Verify device condition, IMEI, and status (lost/stolen/iCloud/MDM);
- Process payment and maintain business records required by tax and accounting law;
- Comply with legal obligations including recordkeeping rules that apply to resellers of used electronics;
- Detect, investigate, and prevent fraud, theft, and abuse of the Site or service;
- Improve the Site, our pricing models, and the customer experience;
- Send service-related SMS and email you have consented to receive;
- Conduct and measure our marketing and advertising.
We do not use personal information for automated decisions that produce legal or similarly significant effects without human review, and we do not sell personal information.
4. SMS / Text Messaging
When you submit our quote form with the consent box checked or text us at (832) 606-9722, you consent to receive text messages from Oscar's Phones at the phone number you provided. Messages may include quote responses, scheduling, appointment reminders, payment confirmations, and follow-ups on open transactions.
Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help.
Mobile opt-in data and consent will not be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7. Data Retention
We keep personal information only as long as needed for the purposes in this Policy, to complete our transactions with you, to maintain business records, and to satisfy legal obligations. In general:
- Quote requests without a completed purchase: up to 24 months.
- Completed transaction records (invoices, IMEI, payment confirmation): at least the period required by applicable tax and secondhand-goods recordkeeping law, which may exceed 5 years.
- SMS opt-in records: for the life of the consent plus a reasonable period after opt-out to demonstrate compliance.
- Website analytics and ad measurement: per the provider's default retention (typically 14–26 months).
When no legal or business purpose remains, we delete or anonymize your data.
8. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information, including encrypted transport (HTTPS/TLS), access controls on our CRM, and device-level protections on staff equipment. No system is 100% secure, and we cannot guarantee absolute security. In the event of a security incident involving personal information, we will notify affected individuals and regulators as required by applicable law.
9. Your Privacy Rights
Depending on where you live, you may have rights regarding your personal information, including:
- Access / Know: request the categories and specific pieces of personal information we hold about you.
- Delete: request deletion of your personal information, subject to legal exceptions.
- Correct: request correction of inaccurate information.
- Portability: request a copy of your information in a portable format.
- Opt out of targeted advertising, sale, or sharing of personal information.
- Limit the use of sensitive personal information.
- Non-discrimination for exercising any of the above rights.
To exercise any right, email oscorp@oscarsphones.com with the subject line "Privacy Request" or call (832) 606-9722. We will verify your identity before responding, typically within 45 days. You may designate an authorized agent to make a request on your behalf with proof of authorization.
10. California Residents (CCPA / CPRA)
If you are a California resident, you have the rights described in Section 9 under the California Consumer Privacy Act as amended by the California Privacy Rights Act.
Categories of personal information we collect, disclose for a business purpose, and the categories of recipients:
- Identifiers (name, phone, email, IP) — disclosed to service providers listed in Section 6.
- Customer records (contact and transaction data) — disclosed to service providers and, in narrow circumstances, to law enforcement.
- Commercial information (devices quoted or purchased) — disclosed to downstream device buyers (de-identified of personal contact info) and to our payment processors.
- Internet or network activity (usage and log data) — disclosed to analytics and advertising providers.
- Inferences (about preferences and behavior) — used internally; not sold.
We have not sold personal information in the preceding 12 months. We may "share" personal information as that term is defined under the CPRA (cross-context behavioral advertising) via ad measurement pixels. You can opt out at any time using the Do Not Sell or Share instructions below, or by enabling a Global Privacy Control (GPC) signal in your browser, which we honor.
Shine the Light: California residents may request a list of third parties to which we have disclosed personal information for their direct marketing purposes in the prior calendar year. We do not share personal information with third parties for their direct marketing.
11. Other U.S. State Rights
Residents of the following states have rights under their state privacy laws comparable to those in Section 9: Texas (TDPSA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Oregon (OCPA), Montana (MCDPA), Iowa, Tennessee, Indiana, Delaware, New Jersey, New Hampshire, and others as their laws become effective.
To exercise your rights, use the contact methods in Section 9. You may appeal a denied request by emailing oscorp@oscarsphones.com with the subject line "Privacy Appeal."
12. Do Not Sell or Share My Personal Information
We do not sell personal information for money. We may "share" personal information as defined by California law for cross-context behavioral advertising. To opt out of all such sharing:
- Email us at oscorp@oscarsphones.com with the subject line "Do Not Sell or Share."
- Turn on a Global Privacy Control (GPC) signal in your browser. We recognize and honor GPC as a valid opt-out.
- Adjust your cookie preferences in your browser or, where offered on the Site, through the cookie banner.
13. International Visitors
Oscar's Phones is based in the United States and serves the Houston, Texas area. If you access the Site from outside the United States, your information will be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your country. Where required, we rely on lawful transfer mechanisms and take reasonable steps to ensure your data is protected.
EU/UK residents have rights under the GDPR and UK GDPR, including access, rectification, erasure, restriction, portability, objection, and the right to lodge a complaint with a supervisory authority. Our lawful bases for processing include performance of a contract, legitimate interests (running our business and preventing fraud), consent (for SMS and marketing), and legal obligation.
14. Children's Privacy
The Site and our services are not directed to children under 13, and we do not knowingly collect personal information from anyone under 13 in violation of the Children's Online Privacy Protection Act (COPPA). We also do not knowingly process the personal information of minors under 16 for the purposes of targeted advertising, sale, or profiling in furtherance of decisions that produce legal or similarly significant effects, without consent from a parent or legal guardian. If you believe a child under the applicable age has provided personal information to us, please contact us and we will delete it.
15. Third-Party Links
The Site may link to third-party websites or services (for example, Instagram, Facebook, Google Maps). We are not responsible for their privacy practices. Please review their policies before providing information to them.
16. Do Not Track Signals
Some browsers transmit Do Not Track (DNT) signals. Because there is no consistent industry standard for DNT, we do not currently respond to browser DNT signals. We do honor Global Privacy Control (GPC) signals as described in Section 12.
17. Changes to This Policy
We may update this Policy to reflect changes in our practices, services, or applicable law. The "Last updated" date at the top of this page reflects the most recent version. Material changes will be announced through a prominent notice on the Site or by direct notice where required. Your continued use of the Site after an update constitutes acceptance of the revised Policy.
